POA Caregiver™ Professional Network Membership Terms

For professionals, practices, firms and organizations that join the POA Caregiver Professional Network.

These terms apply to the POA Caregiver™ Professional Network Membership (“Membership”) offered by POA Caregiver LLC (“POA Caregiver”, “we”). The POA Caregiver Terms of Use also apply. By accepting these terms at checkout, the member (“you”) agrees to them.

1. Paid membership

The Professional Network Membership is paid participation. It is offered as a prepaid, fixed-term membership:

6-Month Professional Network Membership — $500
12-Month Professional Network Membership — $1,000

Prices are in U.S. dollars; applicable sales tax, if any, is shown at checkout. Memberships are not subscriptions and are not billed automatically.

2. Application and approval

Membership is available by application to individual professionals, practices and firms, and appropriate organizations. POA Caregiver reviews each application and may approve or decline any application at its discretion. Applying does not guarantee approval. Completion of The POA Caregiver Professional Program is not required. POA Caregiver may ask for additional information before deciding.

3. Payment after approval

No payment is collected when you apply. If your application is approved, you will receive a secure link to choose a membership term, accept these terms and pay through POACaregiver.com. Payment links are personal to the approved application and may expire.

4. When membership begins and ends

Your membership term begins on the day your public directory profile goes live — not the application, approval or payment date — and runs for the term you purchased (6 or 12 months). If there is a delay between payment and publication, you do not lose paid membership days.

5. Membership benefits

During an active membership, members receive:

A listing in the POA Caregiver Professional Directory and a public professional profile within POA Caregiver;
Visibility by state / service area and by professional category;
A professional contact pathway on the profile (website, and any public business phone or email the member chooses to show);
Monthly Client Education (section 6).

Directory profiles are listed alphabetically. POA Caregiver does not offer or guarantee any ranking, placement, featured position, exclusivity or minimum exposure.

6. Monthly Client Education

Each active member receives POA Caregiver-created educational material intended to help professionals continue useful Power of Attorney conversations with clients and families: a client-ready educational newsletter or content piece, ready-to-send email copy, suggested social copy, and relevant POA Caregiver educational and resource links where appropriate. The same material is provided to all active members; it is not customized for individual members. Members distribute the material through their own communication channels. POA Caregiver does not send the material to members’ clients and does not provide an email-marketing service.

7. Limited right to use POA Caregiver materials

All Monthly Client Education materials and other POA Caregiver content remain the intellectual property of POA Caregiver LLC. During an active membership, POA Caregiver grants the member a limited, non-exclusive, non-transferable, revocable right to share the client-ready materials provided to members with the member’s own clients and contacts, through the member’s own channels, with POA Caregiver attribution kept intact. Members may not resell, sublicense or redistribute the materials for a fee; may not claim ownership of them; and may not alter them in a way that materially changes their educational meaning or adds legal, medical, tax or financial claims. Existing copyright and trademark protections for POA Caregiver™, The 5 Phases of the POA Journey™ and all POA Caregiver content continue to apply. The right to share new materials ends when the membership ends.

8. Your profile and content

You are responsible for the accuracy of the information you provide for your application and profile, and for keeping it current. You confirm that you have the right to provide that information and any materials you supply, and that they are truthful and not misleading. POA Caregiver may edit profile content for length, clarity, consistency or compliance with these terms, and may decline to publish content. Private application details (such as your application email, phone, address and licensure information) are used to review and administer your membership and are not published unless you choose to show business contact details publicly.

9. Professional responsibility and licensure

Members remain solely responsible for their own services, licensure or registration (where applicable), professional representations, client relationships, and compliance with all laws, regulations and professional rules that apply to them. You agree to tell POA Caregiver promptly if a license or registration relevant to your listing lapses, is restricted or is revoked.

10. No endorsement, referral or guarantee

A membership or directory listing is not an endorsement, recommendation, referral, certification or professional credential from POA Caregiver, and POA Caregiver does not certify any member’s competence. POA Caregiver does not guarantee leads, referrals, inquiries, clients, revenue, exposure, ranking or business of any kind. Members may describe themselves as a “POA Caregiver Professional Network Member” during an active membership, but may not state or imply that POA Caregiver endorses, certifies or recommends them.

11. Renewal

Renewal is manual: you choose whether to renew, and you will not be charged automatically. POA Caregiver sends renewal reminders about 60, 30 and 7 days before your membership ends, each with a website renewal link. A renewal paid before your membership ends adds the new term to your current end date. Renewal is offered at the membership prices in effect at the time of renewal.

12. Expiration and 14-day grace period

When a membership ends without renewal, the public profile stops displaying. For 14 days after the end date, the member may renew without submitting a new application (POA Caregiver may ask for updated information); a renewal paid during this period starts a new term on the renewal date and the profile shows again. After the grace period, the membership is marked lapsed and the record is retained; rejoining may require a new application.

13. Cancellation and refunds

Because payment is requested only after approval, there are no declined-applicant refunds. Once a membership has been paid and the profile has gone live, membership fees are generally non-refundable. A member may ask to cancel at any time; cancellation ends the listing but does not automatically result in a full or prorated refund.

14. Removal, suspension and termination by POA Caregiver

POA Caregiver may edit, hide, suspend or remove a profile, or end a membership, if the member breaches these terms or the Terms of Use; provides inaccurate or misleading information; no longer holds a license or registration relevant to the listing; engages in conduct that could harm the people POA Caregiver serves or POA Caregiver’s reputation; or as required by law.

Removal for reasons attributable to the member. If removal or termination results from the member’s breach, misconduct, inaccurate information, licensing or registration problems, legal or regulatory concerns attributable to the member, or violation of these Membership Terms, membership fees are non-refundable.

Removal for other reasons. If POA Caregiver terminates an otherwise compliant member’s listing or membership for reasons unrelated to the member’s breach, misconduct, inaccurate representations, licensing or registration issues, legal or regulatory concerns, or violation of these Membership Terms, POA Caregiver will provide a prorated refund for the unused portion of the active membership term.

15. Founding members

POA Caregiver may recognize some early members as “Founding Professional Network Members.” The designation is recognition only; it does not change pricing or benefits.

16. Changes

POA Caregiver may update these terms and the membership benefits for future terms. Changes take effect for new memberships and renewals after they are posted; the terms accepted at checkout apply to the term purchased.

17. Governing law

These terms are governed by the laws of the State of Minnesota, consistent with the POA Caregiver Terms of Use, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms will be brought exclusively in the state or federal courts located in Hennepin County, Minnesota.
